1 PATIENT RIGHTS
Your rights as a client of CATCH Recovery, “CATCH”, are as follows:
- You have the right to be informed of your rights as a client of CATCH, in the language you can understand.
- You have the right to individual dignity.
- You have the right to know the rules and regulations while you are a client of CATCH.
- You have the right to not be discriminated against on the basis of race, colour, and/or national origin at CATCH. In addition, CATCH does not discriminate on the basis of any other legally protected class – including gender, creed, sexual orientation, disability, and age.
- You have the right to know who will be responsible for your treatment and/or care.
- You have the right to assist in preparing your individualized treatment plan which will be reviewed on a regular basis.
- You have the right to the information necessary to permit you or your legal guardian to make informed decisions about any proposed or alternative treatment and medications, as well as the potential benefits/risks of such care.
- You have the right to refuse any services unless they are court-ordered, or they are required to protect you from harming yourself or others. When doing so, you have the right to be informed of the consequences of such refusal.
- You and, where appropriate, your legal guardian have a right to revoke your consent to treatment at any time.
- If mental health personnel feel that you are a danger to yourself or others, you may be referred to a crisis intake unit for psychiatric evaluation and for possible temporary hospitalization. If severe enough, the police may be called for assistance.
- Those who are adult clients have the right to appoint a family member / significant other to make decisions for you about your treatment should you become incapable of communicating your wishes regarding your care.
- You have the right to decide if you will be involved in any experiments or research, and you have the right to agree, refuse or stop any of these activities if you are involved in them. This will not affect your treatment by CATCH in any way.
- You have the right to personal privacy to the extent possible without compromising your personal safety or that of others.
- CATCH will not use identifiable photographs or videotapes for public relations purposes without the consent of the person served and in the case of a minor, both the person served, and the parent or guardian must consent.
- CATCH strictly prohibits the use of any type of corporal or degrading punishment in any of its programs.
- Your CATCH record and communications are confidential and may not be released, except under special circumstances, without your consent (or the consent of your guardian or guardian advocate when appropriate). Special circumstances include the release of information to your legal representative, in response to a court order, to an aftercare treatment provider, after a threat of harm to another person, or in a case of child abuse or neglect. Further information may be given with the approval of your treatment staff. You have reasonable access to your CATCH record.
- You have the right to insert a statement into the record about your problem or about services you are receiving or wish to receive and should CATCH add statements or responses to this it is done so with your knowledge.
- You have the right to complain or file a grievance in writing and to be told about the outcome of your grievance.
- You have the right to receive the least restrictive treatment available that is appropriate in this facility and that does not compromise your safety or that of others.
- You have the right to be referred to another facility to receive services that CATCH cannot provide.
- You have the right to request a second opinion or outside consultation. Staff will assist you in obtaining these services and let you know if any additional costs may be involved.
- You have the right to be informed of the length of the waiting list should there be one.
- In addition to filing a report with CATCH Clinic Manager, you also have the right to report any instances of abuse, neglect, or exploitation.
2 PATIENT RESPONSIBILITIES
- You are responsible for providing the information needed to manage your care. This shall include proof of guardianship (birth certificate, legal guardianship papers, photo lD, etc.), a copy of the social security card (if applicable), and a copy of the insurance card.
- You are responsible for attending the treatment program as outlined.
- You are responsible for following the instructions for care that you and the service provider have agreed upon.
- You are responsible for participating, to the degree possible, for understanding your behavioural health problems and for developing mutually agreed upon treatment goals with your therapist at CATCH.
- You are responsible for assisting CATCH in maintaining a safe workplace onsite (if applicable).
3 CONFIDENTIALITY AND LIMITS OF CONFIDENTIALITY
It is important that you understand confidentiality, your right to privacy, and the rights of other patients. Also, you must understand the legal limits or exceptions to these rights. Your records will not be released without a signed Release of Information (ROI).
Except under circumstances that fall into these categories:
- A valid medical emergency
- Receipt of a Court Order
- Internal communications
- Data with no patient-identifying information
- Research, audit, and evaluation
- Crime at program/against program personnel
- Child abuse and or neglect and child abuse and/or neglect of the elderly and
- Business associate agreements
4 PRIVACY STANDARDS CLIENT NOTIFICATION
CATCH requires a therapeutic atmosphere at all times. Inappropriate conduct by individuals makes the therapeutic process very difficult. To ensure CATCH provides a safe, therapeutic environment the following considerations of conduct are strictly observed:
If at any time a patient demonstrates the inability to follow program rules, the patient will be asked to leave the session. Depending on the situation the individual may return to the session after a 15-minute time-out. If at any time a patient threatens another patient or staff when asked to take a time-out the individual may be terminated from treatment.
- Patients must maintain confidentiality at all times. Patients are not permitted to discuss what happens during their session or who is in their session with anyone outside of the facility.
- Patients may not be under the influence of any illegal substance, including alcohol. If suspected of being intoxicated while on premises individual may be subject to an alcohol or drug test (urine) and or disciplinary action.
- Patients must maintain an environment free from acts or threats of violence including profanity, yelling, arguing, aggressiveness, or damage to facility property.
- CATCH does not permit any behaviour that compromises the safety of clients or employees.
- Patients may not harass other clients or employees. This includes sexual harassment based on gender, pregnancy, childbirth, or related medical conditions, and harassment based on such factors as sex, race, colour, religion, national origin, ancestry, age, physical disability, mental disability, medical condition, marital status, sexual orientation, family care leave status, or veteran status. Harassing conduct can take many forms and includes, but is not limited to, slurs, jokes, statements, gestures, pictures, or cartoons regarding any or all the types of unlawful harassment identified above. CATCH strongly disapproves of and does not tolerate harassment of employees by patients, managers, or co-workers. Similarly, CATCH will not tolerate harassment of its patients by non-employees or any person with whom CATCH employees have a business, service, or professional relationship (such as patients, physicians, and/or vendors).
- Patients may not discriminate against another client or employee.
- Patients may not share their medications with other clients.
- Patients may not smoke inside the facility. Clients are allowed to smoke a minimum of 25 ft. from the front door of the treatment facility.
- Patients may not use cell phones or text during counseling sessions. Phone use is allowed during breaks.
- Patients must maintain personal hygiene and state the appropriate dress code if attending in-person therapy.
- Patients must participate in the development of their individualized intervention or treatment plan.
- Patients must be on time for scheduled events, classes, groups, and individual sessions.
- Patients must respect the rights of others by confronting inappropriate language and behaviours.
- Patients are not to bring weapons of any type onto the property if attending in-person therapy.
- Patients are not to bring drugs and alcohol on the premises if attending in-person therapy.
- Patients are not to use derogatory language or suggestive comments indicating bigotry, mockery, or negative bias against any group of human beings, based on age, gender, physical appearance, religious background or sexual orientation or important personal beliefs and values.
- Patients are not to engage in storytelling or war stories that glorify the use of or sale of drugs or alcohol.
- Noncompliance with program rules may result in you being administratively discharged from the program.
5 THE GRIEVANCE PROCEDURE
As a patient participating in the CATCH program, you have the right to file a complaint or grievance, for any reason with cause, without fear of discharge or reprisal.
If you believe your rights have been violated or believe that your treatment is, or has been unsatisfactory, you may file a grievance. The steps to follow during the grievance process can be found below:
- When a patient has a complaint or problem, the first step is to approach the person involved to discuss and attempt to resolve the issue or problem.
- If there is no resolution, the next step is to discuss any problems with the counsellor or therapist. The patient and counsellor will try to resolve the issue, if unable to resolve the issue, the patient then completes a Patient Grievance Form and returns it to his/her therapist.
- The therapist will bring the form to the CM within 24 hours for the investigation.
- The CM will attempt to resolve the grievance within 5 days of receipt of the grievance form.
- If the complainant is not satisfied within 5 days, it is brought to the attention of the Castle Craig Board.
- The patient will never be prevented or discouraged from submitting a grievance form.
- The patient will receive written notification of the resolution/decision within 10 days of the final resolution.
- CATCH will monitor and track grievances to ensure there is no consistent repetition of similar grievances; if so, the CM will address and correct the issue.
- Depending upon the nature and/or severity of the complaint, the CM may recommend eliminating one or more steps to resolve the grievance more quickly. A copy of the grievance and forms is available to the patient.
6 SERVICE
As a patient of CATCH, you can expect to receive services from professional staff that are committed to providing you with a positive treatment experience.
7 TRANSFER OF SERVICES
You understand that there may be a need to transfer you to some other location for a higher level of care for substance misuse treatment, intervention services, and medical and mental health needs; depending on the situation. You give the staff of CATCH permission to make such recommendations and assist with the process.
8 EMERGENCIES
For medical emergencies please call 999.
You understand that in the event that CATCH calls emergency services for you and you are unable to provide your information then CATCH will provide your medical and contact information to emergency services
9 CODE OF ETHICS
- Your welfare is always our primary concern.
- All patients are to be treated in a fair and equal manner and no one is given special consideration or advantage over anyone else.
- Staff is not allowed to accept monetary gifts from patients.
- No staff member is permitted to act as a sponsor for a client for any recognized self-help or peer support group (e.g., Alcoholics Anonymous, Narcotics Anonymous, etc.).
- Staff cannot have personal/social relationships with any patient who is receiving or has received services from CATCH.
